These Terms & Conditions apply to electrical work and associated services
provided by ELS Electrical Services Ltd ("ELS", "we", "us" or "our"). By
accepting a quotation, instructing us to commence work or otherwise
entering into an agreement with us, the customer agrees to these Terms &
Conditions.

‍
1. Quotations & Scope of Work

‍
All quotations are based on the information available to us at the time they
are prepared and cover only the work specifically described within the
quotation.
Any work, materials or services not specifically included within the
quotation should not be assumed to be included in the quoted price.
If a customer requests alterations, additions or extra work after a quotation
has been accepted, this will be treated as a variation to the original scope
of work and additional charges may apply.
We will always aim to discuss additional work and associated costs with
the customer before proceeding wherever reasonably practicable.
However, electrical work can sometimes uncover faults, defects or other
circumstances which could not reasonably have been identified before
work commenced. This may include defective existing wiring, inadequate
earthing or bonding, concealed damage, unsafe connections or other
preexisting installation issues. Where additional work is reasonably necessary

to safely complete the agreed work or prevent an immediate safety risk,

and it is not reasonably practicable to obtain approval from the customer

at that moment, ELS Electrical Services Ltd reserves the right to carry out

reasonable necessary work and charge accordingly. We will inform the

customer as soon as reasonably practicable.
Substantial additional or optional work outside the original quotation will
normally be agreed with the customer before it is undertaken.
‍

2. Prices & Additional Costs

‍
The quoted price applies only to the work specified within the quotation.
Additional charges may apply where:
• additional work is requested by the customer;
• unforeseen faults or defects are discovered;
• additional labour or materials are required which could not
reasonably have been anticipated;
• access is substantially more difficult than expected;
• the existing electrical installation requires additional work before the
quoted installation can safely proceed;
• specialist equipment, additional visits or involvement from other
trades becomes necessary; or
• the customer changes the specification after work has commenced.
Where reasonably possible, we will communicate significant additional
costs before carrying out the additional work.
‍

3. Payment

‍
Final payment is due upon the satisfactory completion of the work,
unless alternative payment terms have been agreed in writing beforehand.
For larger projects, deposits, material payments or staged payments may
be required. Where applicable, these will be detailed within the quotation.
For the purposes of these Terms & Conditions, satisfactory completion
means that the agreed scope of electrical work has been completed with
reasonable care and skill. Minor snagging items which reasonably require a
return visit will not automatically prevent payment from becoming due.
‍

4. Older Properties & Existing Building Conditions

‍
Electrical work frequently involves working with or around existing walls,
ceilings, floors, plasterwork, tiles, decorations, fixtures and other building
materials.
ELS Electrical Services Ltd will always take reasonable care while carrying
out work.
However, particularly within older properties, existing materials may be
brittle, deteriorated, damaged, poorly installed or weakened due to age or
previous works.
This may include:
• plaster and plasterboard;
• floorboards;
• tiles;
• brickwork;
• decorative finishes;
• ceilings;
• existing sockets and switches;
• fixtures and fittings; and
• concealed services or building materials.
We cannot accept responsibility for unavoidable damage arising from
pre-existing deterioration, hidden defects or reasonable access
required to undertake the agreed electrical work, provided that we have
carried out the work with reasonable care and skill.
This does not exclude responsibility for damage directly caused by
negligence or a failure by ELS Electrical Services Ltd to exercise reasonable
care and skill.
‍

5. Making Good

‍
Making good is not included unless specifically stated within the
quotation.
Electrical work may require chasing walls, drilling holes, cutting access
openings, lifting floorboards, removing fittings or otherwise disturbing
existing finishes in order to install, inspect, repair or replace electrical
equipment.
Unless specifically included within our quotation, ELS Electrical Services
Ltd does not undertake:
• plastering;
• filling;
• painting;
• decorating;
• tiling;
• carpentry;
• flooring repairs; or
• other building or finishing works.
We will always aim to keep disruption and damage to the minimum
reasonably necessary to undertake the electrical work.
‍

6. Access to the Property

‍
The customer is responsible for providing reasonable and safe access to
the property and the areas where work is required.
Where possible, work areas should be cleared of furniture, personal
belongings and other obstructions before our arrival.
ELS Electrical Services Ltd cannot be held responsible for delays or
additional costs caused by restricted access, undisclosed hazards, other
trades or circumstances outside our reasonable control.
The customer is responsible for obtaining any necessary permission from
landlords, freeholders, managing agents or property owners before
instructing us to undertake work.
‍

7. Existing Electrical Installations

‍
ELS Electrical Services Ltd cannot be held responsible for faults, defects,
deterioration or non-compliance which existed before our work
commenced and which were not included within our contracted scope of
work.
Where unsafe or potentially non-compliant existing electrical work is
discovered, we will advise the customer where appropriate.
Additional remedial works may be quoted separately.
Where an immediate electrical danger is identified, we reserve the right to
take reasonable steps to make the installation safe.
‍

8. Electrical Standards, Testing & Certification

‍
Electrical installation work undertaken by ELS Electrical Services Ltd will
be carried out in accordance with the applicable regulations and standards
relevant to the work, including BS 7671 where applicable.
Appropriate electrical certification will be provided where required for the
work undertaken.
ELS Electrical Services Ltd is a NAPIT certified company and has been
assessed as technically competent within its approved scope of electrical
installation work.
‍

9. NAPIT 6-Year Work Quality Guarantee

‍
Where applicable, qualifying work undertaken by ELS Electrical Services
Ltd may benefit from the NAPIT Work Quality Guarantee.
Eligible work covered by the scheme may receive protection for up to six
years from the date of installation, subject to NAPIT's eligibility
requirements, terms and conditions and the work having been correctly
notified where required.
While ELS Electrical Services Ltd continues to trade, we remain
responsible for addressing qualifying compliance issues arising from our
installation work in accordance with our obligations.
Where an installer is no longer trading, NAPIT may provide protection for
qualifying work under the terms of its Work Quality Guarantee.
The NAPIT Work Quality Guarantee should not be interpreted as an
unconditional six-year warranty covering every product, component,
accessory or electrical fault. Individual products may also be covered
separately by the manufacturer's warranty.
‍

10. Product & Manufacturer Warranties

‍
Where equipment or accessories supplied by ELS Electrical Services Ltd
carry a manufacturer's warranty, the manufacturer's individual warranty
terms and duration will apply.
Manufacturer warranties do not necessarily cover labour costs associated
with removing, replacing or reinstalling a faulty product unless specifically
stated by the manufacturer.
‍

11. Complaints

‍
ELS Electrical Services Ltd aims to provide a professional service and
resolve any concerns fairly and promptly.
If a customer is dissatisfied with any aspect of our work, they should
contact us as soon as reasonably possible:
Email: elselectrics@hotmail.com
Telephone: 07932 600333
Customers should provide details of their complaint and allow us a
reasonable opportunity to investigate the issue.
Where appropriate, we must also be given a reasonable opportunity to
return to the property to inspect or rectify work before another contractor
undertakes alterations to the work concerned.
Where a complaint relates to work falling within our NAPIT registration and
cannot be resolved directly between ourselves and the customer, the
customer may also be able to use NAPIT's complaints procedure.
‍

12. Alternative Dispute Resolution

‍
If a complaint cannot be resolved through our internal complaints
procedure, we are willing to consider an appropriate Alternative Dispute
Resolution (ADR) process where applicable.
ADR provides an alternative way of resolving disputes without immediately
resorting to court proceedings and may include independent mediation,
conciliation or arbitration.
Where relevant, NAPIT may also provide information or assistance
regarding complaints concerning work undertaken by NAPIT registered
businesses.
Details of an appropriate ADR provider can be supplied where required.
‍

13. Cancellation Rights

‍
Domestic customers may have statutory cancellation rights where a
contract has been entered into online, by telephone, at the customer's
property or away from our normal business premises.
Where applicable, a customer may have a 14-day cancellation period.
If the customer specifically asks ELS Electrical Services Ltd to commence
work within this cancellation period, the customer may be required to pay
for work, labour and materials reasonably supplied up to the point of
cancellation.
For urgent or emergency work specifically requested by the customer,
different provisions may apply depending on the circumstances.
Nothing within these Terms & Conditions affects a customer's statutory
rights.
‍

14. Delays & Circumstances Outside Our Control

‍
We will make reasonable efforts to attend and complete work within
agreed timescales.
However, completion dates and times may occasionally be affected by
circumstances outside our reasonable control, including:
• supplier or manufacturer delays;
• unavailable materials;
• illness;
• severe weather;
• unforeseen electrical faults;
• restricted access;
• other trades;
• utility or network operator involvement; or
• emergency works.
We will communicate significant delays where reasonably possible.
‍

15. Customer-Supplied Materials

‍
Where a customer supplies their own electrical accessories, fittings or
equipment, they are responsible for ensuring that these products are
suitable, compatible and of appropriate quality.
ELS Electrical Services Ltd reserves the right to refuse to install equipment
which we reasonably consider unsafe, unsuitable, damaged or noncompliant.
Unless otherwise agreed, we cannot accept responsibility for defects or
failures relating to customer-supplied products.
Additional labour charges may apply if defective or unsuitable customer
supplied products result in additional attendance or installation time.
‍

16. Liability

‍
Nothing within these Terms & Conditions limits or excludes any liability
which cannot legally be limited or excluded.
ELS Electrical Services Ltd will not be responsible for faults, losses or
damage arising from:
• pre-existing defects;
• deterioration or poor workmanship undertaken by others;
• alterations subsequently made by another person or contractor;
• misuse of equipment;
• failure of customer-supplied equipment;
• circumstances outside our reasonable control; or
• defects unrelated to the electrical work we were contracted to
undertake.
Where a customer believes our work has caused a fault or damage, we ask
that they contact us promptly and allow us a reasonable opportunity to
inspect the issue.
‍

17. Photographs & Records

‍
ELS Electrical Services Ltd may take photographs of electrical installations
before, during and after work for record keeping, certification, technical
assessment or evidence of installation conditions.
Photographs containing identifiable personal information will be handled
appropriately.
Photographs will not be used for marketing purposes where an individual
or private information is clearly identifiable without appropriate
permission.
‍

18. General

‍
These Terms & Conditions form part of the agreement between ELS
Electrical Services Ltd and the customer alongside the accepted quotation
and any written variations subsequently agreed.
If any provision within these Terms & Conditions is found to be invalid or
unenforceable, the remaining provisions will continue to apply.
These Terms & Conditions are governed by the laws of England and
Wales.
Nothing within these Terms & Conditions affects a consumer's statutory
rights.
